What Is Pre-Trial Diversion?

 

It is a diversionary program that is run through the District Attorney’s office. Here in Denton County the program is for low-risk first time offenders.

If a person is placed on PTD the case is removed from the court’s docket and the defendant will sign a contract with the DA’s office and be subject to terms and conditions that are virtually identical to the conditions of regular probation or deferred adjudication. If all conditions are successfully completed the case will be dismissed and the defendant will be eligible for an expunction.

If the agreement is violated the case is sent back to the original Court for disposition.
